1. Acceptance of Terms
By downloading, accessing, or using the Oxiom mobile application (the "App"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the App.
These Terms constitute a legally binding agreement between you and Oxiom ("we", "us", "our").
2. Description of Service
Oxiom provides a multi-tenant mobile application that enables organizations and their users to access business workflow tools, including but not limited to authentication, data management, and organizational collaboration features. The App is delivered as a Progressive Web Application (PWA) and integrates third-party services such as Google Sign-In and AWS Cognito for authentication.
3. Eligibility
You must be at least 16 years of age (or the age of digital consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
4. Account Registration and Authentication
4.1 Account Creation
To use the App, you must create an account or sign in through an authorized identity provider such as Google Sign-In. You agree to provide accurate, current, and complete information during registration and to keep such information up to date.
4.2 Google Sign-In
When you use Google Sign-In, you authorize us to receive basic profile information (name, email address, profile picture, and Google account identifier) in accordance with Google's OAuth policies and our Privacy Policy. You may revoke this authorization at any time through your Google account settings.
4.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] of any unauthorized access or use.
5. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App in any way that violates applicable laws or regulations;
- Impersonate any person or entity or misrepresent your affiliation;
- Attempt to gain unauthorized access to any part of the App, other user accounts, or connected systems;
- Interfere with, disrupt, or attempt to circumvent security features of the App;
- Upload, transmit, or distribute any viruses, malware, or malicious code;
- Reverse engineer, decompile, or disassemble any part of the App, except as permitted by law;
- Use automated systems (bots, scrapers, crawlers) to access the App without prior written consent;
- Use the App to send spam, unsolicited messages, or unauthorized advertising;
- Infringe upon the intellectual property rights, privacy, or other rights of any third party.
6. User Content
6.1 Ownership
You retain ownership of any content, data, or information you submit through the App ("User Content"). You are solely responsible for your User Content and the consequences of submitting it.
6.2 License to Us
By submitting User Content, you grant Oxiom a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display such content solely for the purpose of providing and improving the App.
6.3 Content Standards
You represent and warrant that your User Content does not violate any law, infringe any third-party rights, or contain harmful, offensive, or illegal material.
7. Intellectual Property
All rights, title, and interest in and to the App, including its design, source code, features, trademarks, logos, and content provided by us, are and shall remain the exclusive property of Oxiom and its licensors. Nothing in these Terms grants you any right to use our trademarks or intellectual property without our prior written consent.
8. Third-Party Services
The App integrates with third-party services, including but not limited to Google Sign-In, AWS Cognito, and cloud hosting providers. Your use of these services is subject to the respective third-party terms and privacy policies. We are not responsible for the availability, content, or practices of any third-party services.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the data practices described in the Privacy Policy.
10. Subscription, Fees, and Payments
Certain features of the App may be offered as part of a paid subscription or organizational plan. If applicable, fees, billing terms, and cancellation policies will be provided separately at the time of purchase. All fees are non-refundable unless required by applicable law.
11. Termination
11.1 Termination by You
You may stop using the App and delete your account at any time by contacting [email protected] or through account settings within the App.
11.2 Termination by Us
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if:
- You violate these Terms;
- We are required to do so by law;
- Continued provision of the App to you is no longer commercially viable.
11.3 Effect of Termination
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.
12. Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
We do not warrant that the App will be error-free, secure, or continuously available, or that any defects will be corrected.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Oxiom and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the App.
Our total liability for any claim arising out of these Terms or your use of the App shall not exceed the amount paid by you (if any) for the App in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Oxiom and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your User Content, or your misuse of the App.
15. Modifications to the App and Terms
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. Material changes will be communicated by posting the updated Terms with a new "Last updated" date. Continued use of the App after such changes constitutes your acceptance of the updated Terms.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflict of law principles. Any disputes arising from or related to these Terms shall be resolved by the competent courts located in Bosnia and Herzegovina, unless otherwise required by applicable consumer protection laws in your jurisdiction.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Oxiom regarding your use of the App and supersede any prior agreements.
